An Ontario traffic ticket is a provincial offence and the allegation is laid by a police officer under the Ontario Highway Traffic Act. Depending on the offence, a traffic ticket conviction could result in a monetary fine, loss of demerit points, a driver’s licence suspension, and even incarceration.
Minor Criminal Charges
Minor criminal charges in Canada are classified as being Summary Conviction offences under the Criminal Code of Canada. A conviction for a Summary Conviction offence under the Criminal Code carries a maximum penalty of up to 6 months in custody (jail), a maximum fine not exceeding $5,000, or both.
Provincial Offences
Provincial Ontario statutes are governed by the Provincial Offences Act. Provincial offences are classified as quasi-criminal offences, meaning that their court process and procedure is similar to their criminal code counterpart. There are hundreds of provincial statutes regulating things like hunting, fishing, education, off-road and motor vehicles, etc.
Appeals
If you’ve been convicted of a traffic ticket or another provincial offence in or out of court, the Provincial Offences Act allows a convicted person to file an appeal within 30 days of the date of conviction. Provincial Offences Act appeals address errors of law, fact, or both.
